10.5 thousand dollars for a decision in a fatal road accident case: Kropyvnytskyi judge to be tried

A judge of the Kropyvnytskyi Court of Appeal and his accomplice were accused of extorting and receiving a $10,500 bribe for delivering a lenient sentence in a fatal car accident case.
The SAPO prosecutor has sent to court an indictment against a judge of the Kropyvnytskyi Court of Appeal, who, together with another person, was caught asking for and receiving an undue benefit for passing a lenient sentence against the perpetrator of a fatal road accident. This was reported by the Specialized Anti-Corruption Prosecutor's Office, UNN reports .

The pre-trial investigation established that the judge, with the complicity of another person, requested an unlawful benefit in the amount of USD 10.5 thousand. The investigation revealed that the judge, with the complicity of another person, requested an undue benefit in the amount of USD 10.5 thousand for imposing a non-custodial sentence on the person who caused a fatal accident.
Given that the panel of judges of the Kropyvnytskyi Court of Appeal upheld the verdict of the first instance court and sentenced the perpetrator of the accident to imprisonment, most of the funds were returned to the person. During the investigation, law enforcement officers at the intermediary's place of residence found part of the illegally obtained funds in the amount of USD 450. The judge's actions are qualified under Part 3 of Article 368 of the Criminal Code of Ukraine. His accomplice - under Part 5 of Article 27, Part 3 of Article 368 of the Criminal Code of Ukraine. The sanction of the article provides for punishment in the form of imprisonment for a term of five to ten years with disqualification to hold certain positions or engage in certain activities for up to three years, with confiscation of property.
