The Odrex doctors case: PR on a patient's death and accusations of judges' dishonesty

The surgeon of Odrex, Vitalii Rusakov, accused of medical negligence, has launched a public attack on the presiding judge in the case, Viktor Chaplytskyi. The accused is outraged by the number of scheduled hearings.
The accused in the medical negligence case that could have led to the death of patient Adnan Kivan, a doctor at the Odrex clinic, openly criticizes the presiding judge Viktor Chaplytskyi. In numerous video blogs, the accused questions the integrity of the trial and the professional qualities of the judge. How the Odrex doctor is trying to turn the death of his patient into a tool for his own promotion, investigated by UNN.
Since the beginning of the trial, the accused Vitalii Rusakov has systematically brought the course of the case into the public domain. At least once a week, he records videos in which he comments on procedural decisions, evaluates the actions of the court, and publicly discloses information about the health status, treatment, and course of the disease of his patient Adnan Kivan.
Initially, the object of his criticism was Judge Larysa Pereverzieva, who presided over the case before the change of jurisdiction. After the transfer of materials to the Kyiv District Court of Odesa, Rusakov's public accusations are already directed against Viktor Chaplytskyi.
In one of his numerous videos, the doctor directly stated the alleged bias of the presiding judge and his favoritism towards the prosecution.

"Behavior that indicates a particular favoritism of Judge Chaplytskyi towards the prosecution. This is still a targeted case," Rusakov accused the judge.
The accused Odrex doctor links the alleged bias of the judge to the fact that he denied the defense a number of motions. At the same time, the granting or denial of motions in itself is a standard procedural practice and falls within the discretionary powers of the court.
Separately, the surgeon is outraged by the intensity of the trial and demands that his case be heard at most once a month.
"Why does Judge Viktor Chaplytskyi hear serious and especially serious crimes once a month, but my case daily?" the accused stated.
In essence, the accused is seeking not to speed up, but to slow down the proceedings in a case where he himself insists on his innocence. This creates an obvious contradiction. If Rusakov is convinced that he acted in accordance with medical standards, a swift and thorough examination of the evidence should be in his interest. A trial without long pauses would allow for verification of expert conclusions, medical documentation, and the arguments of each party.
Interestingly, despite all the accusations, Rusakov says, "I respect the court." However, this phrase sharply contrasts with the entire content of the video, where Judge Chaplytskyi is accused of inconsistency, bias, favoritism towards one of the parties, and participation in an alleged targeted persecution of the doctor.
In fact, the accused of medical negligence publicly attributes bias to the judge even before the completion of the examination of evidence and the issuance of any decision.
In his videos, the doctor not only criticizes the judge but also urges viewers to promote his content.
"Share this video. The more people see how the system works behind closed doors, the harder it will be to ignore the law. Subscribe to the channel to receive updates and follow the case in real time," Rusakov urges.
Thus, the criminal case about the patient's death is effectively turning into a series for social media, where every court decision becomes a reason for a new video, and the name of the deceased becomes a tool for attracting subscribers.

Doctors of the private clinic Odrex, Vitalii Rusakov and Maryna Bielotserkovska, are accused under Part 1 of Article 140 of the Criminal Code of Ukraine – improper performance of professional duties by medical workers.
According to the investigation, after the surgery, doctors may not have prescribed the necessary antibacterial therapy to patient Adnan Kivan and may have inadequately responded to postoperative complications. According to the conclusions of the forensic medical examination, this could have led to the development of sepsis and the patient's death. The accused do not admit their guilt. The final assessment of the evidence and the actions of the doctors is to be provided by the court.
