Parliament plans to consider a draft law on the introduction of EU customs practices in Ukraine

The Verkhovna Rada plans to consider a draft law on the introduction of European customs practices in Ukraine. The draft law provides for the approximation of national legislation to EU norms and the introduction of new customs terms and procedures.
The Verkhovna Rada plans to consider in the second reading a draft law on the introduction of European practices in the implementation of customs in Ukraine, the approximation of national legislation to EU legislation. UNN reports this with reference to the agenda of the Verkhovna Rada meeting.
According to the government's representative in parliament, Taras Melnychuk, draft law No. 10411 also proposes to introduce new terms and bring the existing terminology of the Customs Code of Ukraine in line with the terminology of European legislation.
According to the explanatory memorandum, the draft law is proposed taking into account the best European practices, in particular:
- introduce new terms and bring the existing terminology of the Code in line with the terminology of European legislation, in particular Regulation No. 952/2013;
- to introduce the concept of customs representation similar to that used in the EU countries, defining the general principles of representation, dividing the types of representation into direct and indirect, and delineating the responsibilities of the foreign economic entity and the customs representative;
- to improve the criteria for granting authorizations as a result of the existing need to eliminate inaccurate wording after the start of consideration of applications for authorization to apply simplifications;
It is also proposed to introduce a European approach to generalizing the provisions on customs regimes, in particular, to supplement the Code with new articles providing for changes, in particular, in the following areas:
- authorizations for the placement of goods in the customs regimes of import (in terms of the end-use procedure), temporary import, processing in the customs territory, and processing outside the customs territory;
- introducing a condition for storing documents and keeping records as a condition for obtaining an authorization; - defining a mechanism for transferring the rights and obligations of the authorization holder (procedure holder);
- providing an opportunity to move goods under customs control under the relevant customs regime without placing the goods in the customs transit regime;
- expanding the list of ordinary transactions with goods and clearly regulating the requirements for their implementation;
- equivalent goods and the terms of their use;
- completion and termination of customs regimes, reporting on the completion of the customs regime;

The Verkhovna Rada adopted as a basis the draft law No. 10411 on the introduction of European practices in customs in Ukraine, approximation of national legislation to EU legislation.
