The Supreme Court upheld the verdict of two former Berkut commanders for beating up a Euromaidan activist in 2013. The convicts received 3 years in prison and a ban on working in law enforcement agencies.
The Supreme Court upheld the verdict of two ex-employees of the Berkut special police battalion, Viktor Eismont and Vladimir Mokhon, who beat up a Euromaidan activist, reports UNN with reference to the court.
" The Criminal Court of Cassation, as part of the Supreme Court, upheld the decisions of the courts of previous instances regarding the imposition of punishment, according to which ex-law enforcement officers were found guilty of abuse of power and official authority (Part 1 of Article 28, Part 2 of Article 365 of the Criminal Code of Ukraine (as amended by the law of Ukraine of April 7, 2011 No. 3207-VI)). They were sentenced to three years ' imprisonment and banned from holding positions in law enforcement agencies for a period of three years," the report says.
In addition, according to court decisions, former employees of the special forces were found guilty of obstructing peaceful assemblies (part 1 of Article 28, Part 2 of Article 340 of the Criminal Code of Ukraine) and official forgery (part 1 of Article 366 of the Criminal Code of Ukraine), but they were released from serving their sentences due to the expiration of the statute of limitations.
The lawyer's Advisory Group notes that we are talking about Berkut soldiers Eismont and Mohon in the case of the Maidan crackdown on November 30, 2013.
"This case will be important for other proceedings on the events of 30.11.2013 - the dispersal of the student Maidan. Currently, it is the first one that has passed all the judicial instances, and ended with an indictment, and even more importantly - a real guilty verdict. Unfortunately ,this verdict may remain unique precisely in its reality, due to the lengthy consideration of other court cases and the expiration of the statute of limitations," said after the meeting, the victim's representative Svetlana Petrakovskaya.
According to the courts, on November 30, 2013, on Maidan Nezalezhnostand in Kiev, two platoon commanders of the operational company of the Berkut special police Regiment ran up to a participant of a peaceful assembly, who fell near the Independence monument as a result of a stampede. They grabbed the victim by the arms and legs, dragged him several meters in the direction of Institutskaya Street, then raised him to his feet, using physical violence, and took the victim out of the territory of Independence Square.
Later, the detained participant of the peaceful assembly was taken to the district police department, where protocols on administrative detention and an administrative offense were drawn up.
The court partially satisfied the victim's cassation appeal, as a result of which the amount of non-pecuniary damage increased from 50 to 400 thousand UAH.
