"Rotterdam+": Court scheduled the case for consideration

The HACC has scheduled the hearing of the "Rotterdam+" case, involving officials from the NEURC and entrepreneurs, for April 18, 2025. Consumers overpaid more than UAH 39 billion.

The High Anti-Corruption Court has scheduled the hearing of the "Rotterdam+" case for April 18. Among the defendants in the case are former and current officials of the National Commission for State Regulation in the Energy and Utilities Sectors, as well as a group of private entrepreneurs from heat generating companies, UNN writes referring to the Specialized Anti-Corruption Prosecutor's Office.

"As a result of the preliminary hearing, the panel of judges of the HACC scheduled for consideration on the merits the case against persons, including former and current officials of the National Commission for State Regulation in the Energy and Utilities Sectors (hereinafter – NECRC), and a group of private heat generating companies involved in the introduction and application of the "Rotterdam+" formula, as a result of which electricity consumers overpaid more than UAH 39 billion during 2016–2019," the statement said.
The SAP informed that the hearing on the case is scheduled for April 18, 2025 at 11 a.m.
Recall
On March 14, 2023, SAP prosecutors, based on the results of the NABU investigation, sent to court an indictment against six persons involved in the introduction of the "Rotterdam+" formula.
The investigation is convinced that the mentioned formula led to UAH 19.357 billion in losses to electricity consumers during 2016–2017.
Among the accused:
• Chairman of NECRC;
• member of NECRC;
• Head of NECRC Department;
• Head of NECRC Department;
• Deputy Commercial Director of one of the private companies of the group – the key operator of the heat generation market in Ukraine;
• Director of the department of one of the companies of the mentioned group (positions indicated at the time of the crime).
The actions of all defendants in the case were qualified under the elements of a crime under Part 2 of Article 364 of the Criminal Code of Ukraine (abuse of power or official position). Representatives of private companies are charged with aiding and abetting this crime.
"On January 2, 2024, the second episode in the case was sent to court, namely the indictment against 14 persons, including former and current officials of the NECRC and a group of private heat generating companies involved in the introduction and application of the "Rotterdam+" formula, as a result of which electricity consumers overpaid more than UAH 20 billion during 2018–2019," the SAP said.
Defendants in the case:
• 2 former heads of NECRC;
• 6 former and 2 current members of NECRC;
• current and former employees of NECRC;
• 2 current officials of a group of private heat generating companies.
Materials regarding another former member of NECRC have been separated into a separate proceeding.
After some time, the two episodes were merged into one criminal proceeding.
