Juvenile prosecutors of the Kyiv City Prosecutor's Office proved in court that a Kyiv resident, while in the parking lot of the Prospekt shopping and entertainment center, deliberately kicked a 17-year-old boy in the head during a verbal conflict, causing him serious bodily harm.
In April 2023, the Desnianskyi District Court of Kyiv sentenced a man to 5 years in prison for inflicting grievous bodily harm on a minor (part 1 of Article 121 of the Criminal Code of Ukraine). He partially pleaded guilty in court, but appealed the verdict.
Subsequently, the appellate court changed the court's verdict and commuted the sentence, releasing the convict from serving his sentence on probation.
The juvenile prosecutors of the Kyiv City Prosecutor's Office appealed the decision in cassation. The Supreme Court overturned the commutation of the sentence, returning the case to the Kyiv Court of Appeal.
"Due to the principled position of the prosecutors, the court of appeal upheld the verdict and sentenced the Kyiv resident to a real prison term of 5 years," the prosecutor's office said in a statement.
