Shevchenkivskyi Court of Kyiv has recognized Yulia Sosedka as a victim in the case against Oleksandr Zyma, Director of the NBU Legal Department. The case concerns the NBU's recommendation to withdraw Concorde's claims for UAH 63.5 million.

The Shevchenkivskyi District Court of Kyiv has recognized Yulia Sosiedka, co-founder of Concord Bank, as a victim in criminal proceedings over alleged abuse of power or office that led to grave consequences.

As UNN reported, the criminal case concerns a letter from the National Bank of Ukraine to the Deposit Guarantee Fund signed by Oleksandr Zyma, in which he recommended that the Fund withdraw the lawsuits filed by Concord against the NBU. The document referred to four lawsuits filed by Concorde Bank against the NBU, in which the bank demanded to cancel fines totaling almost UAH 63.5 million. These lawsuits were filed before the NBU decided to liquidate Concorde and put it under temporary administration.

The court's decision states that Yulia Sosiedka filed a statement with the investigator of the Territorial Department of the State Bureau of Investigation in Kyiv to recognize her as a victim in the criminal proceedings against Zyma, but the investigator unreasonably refused to satisfy it.

Given that this decision of the investigating judge of the Shevchenkivskyi District Court of Kyiv canceled the decision of the investigator of the First Department of the Territorial Department of the State Bureau of Investigation located in Kyiv, Lytvynenko D.P., to refuse to recognize the victim ..., Sosedka Yu. V. is a victim in the criminal proceedings of 12/28/2023 on the grounds of a criminal offense under Part 2 of Art. 364 of the Criminal Code of Ukraine, from the moment of filing an application for involvement by the victim, that is, from 02/22/2024

Oleksandr Zolotukhin, a member of the National Bar Association, believes that Zyma was in a direct conflict of interestwhen he recommended that the Deposit Guarantee Fund withdraw the lawsuits filed by Concord Bank against the NBU before the start of its liquidation procedure.

Last year, for the first time in Ukraine, not only bankrupt banks but also profitable institutions were subject to liquidation and license revocation, including Concord Bank. The process of depriving a banking institution of its license takes place without a court. Of course, the owners and shareholders of banks may appeal the decision of the regulator, the NBU, after it has made a decision to liquidate the bank, but in general, the process of withdrawing a banking institution from the market, once it has been launched, is irreversible. 

In addition, the issue of liquidation of a profitable bank is not regulated in Ukraine . According to Olena Sosedka, co-owner of Concord Bank, when the regulator announced the decision to liquidate the bank, the financial institution had enough highly liquid assets to make all the necessary payments in 2-3 weeks. But the process of bank liquidation is strictly regulated by law and can generally take up to three years.
