Addendum
On June 24, the Ministry of Economy, Environment and Agriculture of Ukraine approved an order establishing new criteria for determining enterprises, institutions and organizations that are of significant importance for sectors of the national economy.
According to the order, updated requirements are set for business entities in various sectors of the economy, including the agricultural sector, forestry, industrial parks, the environmental sector, and the activities of foreign representative offices.
For example, the conditions for determining criticality are:
- receiving state financial support in the form of
grants;
- performing works and providing services for the Ministry of Economy
on the basis of contracts concluded for a period of at least six months;
- being under the management of the Ministry of Economy;
- conducting activities in three or more regions of Ukraine - such business entities must have an average number of insured persons of at least 10 employees and confirm payment of taxes, fees and the single contribution in the amount of at least UAH 24,000 per region over the last three months;
- being a participant in an industrial park and carrying out economic activities within the industrial park;
- enterprises included in the list of manufacturers of machinery and equipment that are included in the relevant lists of the Ministry of Economy and may receive state support under the "Made in Ukraine" policy.
The order also introduces criteria regarding the minimum average wage level for certain categories of enterprises:
- for enterprises with an average number of insured persons of at least 50 employees, the average wage must be no lower than the national average for the previous reporting year multiplied by a factor of 2;
- for enterprises with a staff of at least 20 employees, a factor of 3 is established.
For forestry enterprises, the minimum area of forest land under permanent use has been increased from 500 to 2,500 hectares. An alternative criterion regarding the number of insured employees is set at no less than 10 persons. A minimum annual enterprise income of at least UAH 10 million is also provided.

As of June 1, 2026, updated rules for reserving military-liable employees of critically important enterprises came into effect in Ukraine. The government has revised approaches to determining business criticality, changes requirements for wage levels, and clarifies the procedure for calculating reservation quotas.
