The Odrex doctor, who is being tried for medical negligence, complains about the court's decision to restrict his professional activities. Prosecutors explain that the restriction is related to the risk of influencing potential witnesses with whom the accused may work.
The accused of improper performance of professional duties by a medical professional, which could have caused serious consequences for the patient and led to the death of businessman Adnan Kivan, the Odrex surgeon is dissatisfied with the court's decision to suspend him from professional activities at the clinic, reports UNN.
The prosecutor justified the need for such a restriction by the fact that after returning to work at Odrex, the accused could contact clinic employees who may be witnesses in the case.
In his vlog, however, the accused called these arguments unfounded. And accused the prosecutor of persecution. In addition, in each of his video addresses, the accused Rusakov calls on those interested to come to court hearings. At almost all hearings, a "support group" was present in the hall. At the same time, during the last hearing, which ended only with the postponement of the hearing due to the sick leave of the defense attorney of another accused, such a "support group" no longer came to court. Perhaps the reason was that Rusakov's lawyers could have known about the postponement of the court hearing earlier than the judge himself.
The accused's lawyer also stated that the high mortality rate from cancer proves the surgeon's innocence.

At the same time, the criminal proceedings against Rusakov and another accused, Maryna Bielotserkovska, concern not the very fact of the patient's death, but the court's examination of the circumstances of providing medical care to a specific patient and establishing whether there was improper performance of professional duties and whether there is a causal link between the actions of the medical workers and the consequences that occurred.
Meanwhile, the court process is still in the preparatory stage. More than seven months have passed since the indictment was submitted to the court, but the examination of the case on its merits and the investigation of evidence have not yet begun.
The reason for this was regular postponements for various procedural reasons: sick leave or non-appearances of the accused's lawyers, motions to recuse prosecutors, judges, and change jurisdiction, as well as sick leave of the accused themselves.
A paradoxical situation arises – instead of going through all stages of the trial and proving innocence, the accused doctors and their representatives may deliberately delay the proceedings, experts say. The reason for this may be the hope of closing the case without a verdict due to the expiration of the statute of limitations.
