“Deputy compensation": the case of ex-MP Patskan returned to court

The Supreme Court overturned the decision to close the case of former MP Patskan regarding the illegal receipt of UAH 117 thousand in compensation for housing. The case was sent for reconsideration to the HACC Appeals Chamber.

The Criminal Court of Cassation of the Supreme Court has sent the case of “deputy compensation” against former MP and former head of the Accounting Chamber Valeriy Patskan to the HACCU Appeals Chamber for a new hearing. This was reported by UNN with reference to the Supreme Court.

On December 19, a panel of judges of the Criminal Court of Cassation of the Supreme Court considered the prosecutor's cassation appeal against the decision of the Appeals Chamber of the High Anti-Corruption Court to close the criminal proceedings against the former MP.

“Following the consideration of the cassation appeal, the panel of judges of the Supreme Court Cassation Court partially upheld the prosecutor's cassation appeal and decided to cancel the decision of the HACCU and send the criminal proceedings for a new appeal,” the statement said.

On October 24, 2022, Valeriy Patskan was notified of suspicion of illegally receiving UAH 117 thousand in compensation for renting an apartment in the capital. 

According to the materials of the criminal proceedings, the former MP is charged with abuse of office (part 2 of Article 364 of the Criminal Code of Ukraine). He received compensation for rent despite the fact that he owned an apartment.

The court of first instance found the former MP guilty of committing a crime under Part 1 of Art. 364 of the Criminal Code of Ukraine and, pursuant to paragraph 3 of Part 1 of Art. 49 of the Criminal Code of Ukraine, released him from serving his sentence due to the expiration of the statute of limitations.

In April 2024, the HACCU overturned the verdict of the court of first instance and closed the criminal proceedings due to the absence of corpus delicti in the actions of the former MP.
