Case of ex-head of the Accounting Chamber sent for a new appeal - SAPO

The Criminal Court of Cassation of the Supreme Court overturned the ruling of the HACC Appeals Chamber in the case of illegal seizure of an apartment. The case of the ex-head of the Accounting Chamber and two other persons was sent for a new appeal.
The case against the former chairman of the Accounting Chamber, a member of the Chamber and her nephew has been sent for a new appeal hearing. This was reported by the Specialized Anti-Corruption Prosecutor's Office, UNN reports.
In particular, the Criminal Court of Cassation of the Supreme Court partially upheld the cassation appeal of the SAPO prosecutor, overturned the decision of the HACC Appeals Chamber and sent the case for a new trial to the HACC Appeals Chamber,
The SAPO notes that during the pre-trial investigation, sufficient evidence was collected to confirm that the said persons, by abusing their official position, by prior conspiracy, seized state property, namely an apartment worth almost UAH 1.4 million (prices as of the end of 2013).
By the verdict of the HACC of April 6, 2023, the former Chairman and member of the Accounting Chamber and her nephew were found not guilty of committing a criminal offense under Part 5 of Article 191 of the Criminal Code of Ukraine due to the absence of criminal offense in their actions.
The HACC Appeals Chamber upheld the decision.
Disagreeing with these decisions of the judges, the SAPO prosecutor will file a cassation appeal to the Supreme Court.
