The Cabinet of Ministers has submitted a draft law to liquidate the Medical Expert Commission and create a new system for assessing work capacity. Starting in 2025, expert teams in hospitals will assess the condition of patients in three categories.

The Cabinet of Ministers has sent a draft law to parliament that establishes an algorithm for assessing the daily functioning of individuals. Prime Minister Denys Shmyhal spoke about the details of the MSEC reform during a government meeting, UNN reports.

The old bureaucratic system of the MSEC will be eliminated. It will be replaced by a new efficient mechanism that is focused on people and their needs. We have already taken the first step. The Government has submitted a draft law to the Verkhovna Rada that establishes an algorithm for assessing a person's daily functioning

- Shmyhal said.

Shmyhal noted that practicing doctors in multidisciplinary hospitals, as part of expert teams, will assess the patient's condition in one of three categories: persistent total disability, persistent partial disability, or full disability. The assessment will be possible in various formats - remotely, in absentia, and on-site. The system will be digitized with a focus on results: maximum rehabilitation, returning the patient to an active life, and adapting the workplace to meet their needs.

He said that the draft law should regulate social services and insurance payments, as well as payments that will depend on the assessment of the state of working capacity.

Their size for people with total permanent disability will increase significantly compared to the current one

- The Prime Minister added. 

He noted that the state will compensate the difference in wages for people with partial permanent disability, taking into account the earnings they had before the insured event and after returning to work.

In addition, the proposed amendments extend the period of paid treatment and rehabilitation from 4 months to 1.5 years, and provide protection from dismissal for the entire period of treatment.
