The Verkhovna Rada supported in the first reading the draft law No. 12209 on reforming the system of working capacity assessment. The draft law provides for the introduction of a new “ability to work” status, an individual approach to rehabilitation, and the automation of payments.

"In continuation of the topic of liquidation of the MSEC. The Verkhovna Rada has adopted in the first reading (draft law) No. 12209 - the formation of comprehensive social support for people with disabilities. "There were 230 votes in favor," MP Yaroslav Zheleznyak wrote on Telegram.

According to the MP, it is about:

Introduction of the "ability to work" status along with the "disability" status:

        - The "work capacity" status will take into account the impact of functional limitations on the person's ability to work.

        - Performance assessment is integrated into the rehabilitation process.

Individual approach to rehabilitation:

        - Health recovery is based on individual needs, including assistive devices, social services, free medicines, and retraining.

        - Performance assessment is carried out after completing a full course of rehabilitation.

Automatic calculation of insurance payments:

        - The status of "permanent total disability" provides automatic monthly insurance payments with the possibility of adjusting depending on other sources of income.

        - The status of "persistent partial disability" provides support in employment, training or retraining and payments subject to active participation in the rehabilitation process.

        - Persons with the status of "able to work" are considered to be in no need of social insurance support.

Remote and anonymous health assessment:

        - Conducted on the basis of information without personal data, the application is submitted after rehabilitation in electronic or paper format.

        - The evaluation is carried out by independent experts.

Strengthening financial support during rehabilitation:

        - Increase in payments for people temporarily unable to work due to illness or injury.

        - Insurance payments can last up to one year in complex cases.

A one-time insurance payment:

        - A one-time insurance payment in connection with an industrial accident or occupational disease will be made regardless of how the accident or disease affected the victim's ability to work.

As MP Oleksiy Honcharenko pointed out, draft law No. 12209 concerns the modernization of the social insurance system to effectively support persons who have partially or completely lost their ability to work.

The draft law provides for the creation of conditions for rehabilitation, restoration of working capacity and financial independence. It provides for the introduction of "rehabilitation payments" for people who need long-term treatment and recovery.

There is also support for people with partial disabilities in returning to work, finding a new job, or studying.
