President signed the law on liquidation of the MSEC: what will change in 2025

Starting January 1, 2025, the MSEC will be liquidated and replaced by expert commissions in cluster hospitals. All previous decisions of the MSEC will remain in force, and the new system of assessing the functioning of individuals will be implemented in stages.

President of Ukraine Volodymyr Zelenskyy has signed a law on the liquidation of medical and social expert commissions (MSECs) starting January 1, 2025.  Instead of the MSEC, expert commissions will be created in cluster hospitals with a new system for assessing the functioning of a person. UNN reports this with reference to the card of the document. 

The powers, rights and obligations of the medical and social expert commissions to conduct medical and social expertise, as well as the powers, rights and obligations of the Central Medical and Social Expert Commission of the Ministry of Health of Ukraine shall be terminated on December 31, 2024.

According to document , persons who have been diagnosed with a disability by the medical and social examination bodies are guaranteed the preservation of their status and social protection in the full scope provided for by the legislation of Ukraine for persons with disabilities for the established period of disability;

documents confirming disability for adults are:

- extracts/references to the medical and social examination report issued by the medical and social examination commission in the forms approved by the central executive body responsible for the formation and implementation of state policy in the field of healthcare by December 31, 2024;

- an extract from the decision of the expert team assessing the person's daily functioning to establish disability in the form approved by the central executive body that ensures the formation and implementation of state policy in the field of health care;

- decisions made by medical and social expert commissions, documents issued on the basis of such decisions are legal and valid, are equivalent to the decisions of expert teams assessing the daily functioning of a person, documents issued on the basis of such decisions of expert teams (including extracts from decisions), and continue to be the basis for registration or extension of the provision of rights, statuses, benefits, pensions, allowances, compensation, allowances, other social guarantees, etc. to persons with disabilities, including for the purposes specified in the laws of Ukraine "O

- persons whose disability is established without specifying a time limit for re-examination undergo an assessment of the person's daily functioning at their own request (at the request of the guardian - in case of deprivation of legal capacity);

- for persons with disabilities whose re-examination was scheduled from January 1, 2025, but who failed to undergo it in a timely manner, the disability period is extended until the date of the decision based on the results of the assessment of the person's daily functioning, but no longer than July 1, 2025.

If a person's disability (with an indication of the re-examination period) was established before the entry into force of this Law and the re-examination period fell during the period of martial law on the territory of Ukraine, but such a person, in accordance with the conditions established by the Cabinet of Ministers of Ukraine, did not undergo such a re-examination by medical and social expert commissions:

- men aged 25 to 60 years who have been assigned the second or third disability group with an indication of the re-examination period are required to undergo an assessment of a person's daily functioning in accordance with this Law and the Procedure for Assessment of a Person's Daily Functioning approved by the Cabinet of Ministers of Ukraine between April 1, 2025 and November 1, 2025;

- other persons, except for persons who cannot be referred for an assessment of the person's daily functioning, shall undergo an assessment of the person's daily functioning until April 1, 2026.

For persons whose referral for re-examination or assessment of daily functioning is impossible in accordance with the grounds determined by the Cabinet of Ministers of Ukraine, the assessment of daily functioning is postponed to the period after the termination or lifting of martial law, but no later than six months after its termination or lifting. At the same time, the disability and the degree of loss of professional ability to work (in percentage terms) for such persons shall be extended until the last day of the sixth month after the termination or lifting of martial law, unless the assessment of the person's daily functioning is carried out earlier.
