The Cabinet of Ministers is preparing a new draft law on public procurement: MP tells what the document envisages

The government plans to submit a new draft law on public procurement to the Rada with a number of important changes. New deadlines, a ban on procurement from certain countries, simplified procedures and other innovations are proposed.

Today, the Cabinet of Ministers is to approve and submit to the Verkhovna Rada a new draft law on public procurement. The document, in particular, introduces a ban on procurement from Russia, Belarus and Iran and introduces simplified procedures.  This was  announced on Friday by MP Yaroslav Zheleznyak, UNN reports.

According to Zhelezniak, the innovations in the document are: 

1. Definition of terms:  Terms such as "aggregate procurement", "veteran enterprise", "open project competition" and others are defined. This contributes to a clearer regulation of the public procurement process. 

2. Prohibition of procurement from certain countries: A ban is introduced on public procurement of goods, works and services from persons from the Russian Federation, the Republic of Belarus, Iran and other countries. This includes legal entities associated with these countries, even if they are registered in Ukraine.

 3. Regulation of the procurement procedure: The rules for procurement, including the use of special safeguards, are defined. Conditions for negotiations and qualification of candidates are established. 

4. Simplified procurement: The draft act proposes the introduction of new procurement methods, including innovative partnerships and dynamic procurement systems. This allows for the introduction of new procurement methods without mandatory publication in English. 

5. Alternative options: Introducing options for tender proposals that allow for alternative specifications. This provides flexibility in selecting offers that meet the minimum requirements. 

6. Regulation of procurement for small amounts: For procurements that do not exceed UAH 200 thousand, the contracting authority may make them without using the electronic procurement system. This simplifies the procurement process for small amounts. 

7. Model contract: The Cabinet of Ministers of Ukraine may approve a model contract for procurement of a specific item. This allows for standardization of contractual terms and conditions and facilitates the procurement process.

The Cabinet of Ministers has adopted a resolution that will allow to purchase drones made in Ukraine through the closed Prozorro functionality. Previously, only foreign-made drones could be purchased through Prozorro.
