Voluntary return to service after the NWCH: almost 4 thousand military personnel applied with petitions

Almost 4 thousand servicemen filed a petition to return to service after desertion, half of them have already been granted. Military personnel who return before January 1, 2025, will be released from criminal liability.
Since the entry into force of the law on voluntary return to service by those liable for military service who left military units or deserted for the first time, almost 4 thousand military personnel have already applied with relevant petitions, half of them have returned to fulfilling their constitutional duty. About it UNN reports with reference to the specialized prosecutor's office in the field of defense of the central region.
"Since the entry into force of this law, almost 4 thousand servicemen have already applied for relevant petitions, half of them have been satisfied by the courts and the servicemen have returned to fulfilling their constitutional duty. The remaining petitions are under consideration in the courts," the report says.
Thus, it is reported that military personnel who for the first time voluntarily left military units or places of service or committed desertion, and who voluntarily arrive no later than January 1, 2025 in military units and express their readiness to continue military service, will continue their military service, contract validity, as well as the payment of monetary security and the implementation of food and other types of security, as well as other benefits and social guarantees established by the legislation of Ukraine.
The corresponding accruals will be restored from the moment of return to the service.
Military personnel or their commanders should inform the relevant specialized prosecutor's offices in the field of Defense, territorial departments of the state Bureau of Investigation, National Police bodies or territorial departments of the military law enforcement service about their intention to return to military units for further military service.
The existence of criminal proceedings on the fact of unauthorized abandonment of a military unit or place of service or desertion is not a reason for refusing to extend military service and contract validity.
In the future, such servicemen who have taken the path of Correction will be subject to the procedure of exemption from criminal liability, which became possible after the adoption of the law of Ukraine No. 3902-IX "on amendments to the Criminal Code of Ukraine, the Criminal Procedure Code of Ukraine and other laws of Ukraine on improving criminal liability for crimes against the established procedure for military service during martial law", which entered into force on September 7, 2024.
407 ("unauthorized abandonment of a military unit or place of Service") and 408 ("desertion") committed under martial law, the legislation provides for a penalty of at least 5 years in prison.
Thus, in relation to military personnel who will not return to military units before January 1, 2025, the pre-trial investigation will be carried out in a general manner.
