According to a temporary court injunction in a case brought by the AFL-CIO union, Social Security Administration officials are not authorized to allow the Department of Government Efficiency (DOGE), including Musk, and the DOGE SSA team to access personally identifiable information. According to the ban, Musk and DOGE are ordered to remove all non-anonymized personal data from their possession. They are also prohibited from accessing SSA computers or code.
Judge Ellen Lipton Hollander wrote that the SSA violated administrative and privacy laws when it granted DOGE "unfettered access to the personal and private data of millions of Americans, including Social Security numbers, medical records, mental health records, hospitalization, driver's license numbers, bank and credit card numbers, tax information, work history, birth and marriage certificates, and home and work addresses."
Hollander's order allows the SSA to grant DOGE members "access to redacted or anonymous data and records" if they undergo standard training for employees who typically work with Social Security data systems to ensure they understand current federal laws that protect the privacy of information.
The judge added that "DOGE has not formulated any reason why their team needs unlimited access to the entire SSA record system, thereby exposing private information that millions of Americans have entrusted to their government."
Reaction of the Social Security Administration (SSA)
The interim head of US Social Security, Lee Dudeck, suggested that he might shut down the agency that manages the social protection program for the elderly and people with disabilities.
