The Verkhovna Rada Committee on law enforcement recommended the adoption of a bill on punishment for leaking information from state registers. Violators face from 5 to 8 years in prison and a ban on holding certain positions.

The Verkhovna Rada Committee on law enforcement recommended that the parliament adopt the bill in the second reading, which provides for a penalty of 8 years behind bars for leaking information from state registers. Earlier, the same draft law was "rejected" and sent for a second reading. This is reported by UNN with reference to the card of the draft law No. 10242.

Details

According to the draft law, it is planned to introduce a penalty of imprisonment for a term of five to eight years with deprivation of the right to hold certain positions or engage in certain activities for a term of one to three years for publishing information from state registers during martial law.

The same penalty will be imposed for unauthorized sale or dissemination of information with restricted access that is stored in computers, automated systems, computer networks or on carriers of such information under martial law.

From six to eight years plans to punish for unauthorized actions with information that is processed in electronic computers (computers), automated systems, computer networks or stored on carriers of such information, committed by a person who has the right to access it under martial law.

The document states that unauthorized interference should be understood as the commission without a legal basis of actions that change the mode of operation or completely or partially stop the operation of information (automated), electronic communication, information and communication systems, including public electronic registers, electronic communication networks, by a person who has not received access rights and interference to such systems, registers and networks in accordance with the procedure established by law.

"Unauthorized sale or dissemination of information with restricted access should be understood as committing actions without a legal basis for the paid or gratuitous transfer of such information to another person who does not have the right to receive it, or posting free access to such information, or other actions that create the possibility of free access to such information for an indefinite circle of persons," the draft law says.

The explanatory note to the draft law states that its purpose is to establish criminal liability for unauthorized interference, sale or dissemination of information processed in public electronic registers and strengthen criminal liability during martial law for criminal offenses in the use of information and communication systems.

This bill was registered in November last year. In January 2024, it was adopted as a basis. In July of this year, the Rada tried to pass it in the second reading, but there were not enough votes and it was sent for a second reading.

On November 27, the relevant committee on law enforcement issues prepared the draft law for a second reading and recommended that the parliament adopt it in the second reading and as a whole as a law, in the version proposed by the committee, with the necessary technical and legal amendments.

The Verkhovna Rada supported in the first reading a bill that exempts journalists from responsibility for moving around the street during curfew if they perform the tasks of their professional activities. The document also proposes to abolish responsibility for the dissemination of certain information for online media.
