As the investigation established, one of the convicts is a resident of the temporarily occupied Donetsk. On the first day of the full-scale invasion of Russia, he voluntarily "mobilized" to the occupation groups of the Southern Military District of Russia. There he was appointed as a rifleman in the 115th Rifle Regiment of the aggressor country and sent to the location of the invaders near Horlivka. From there, the traitor's unit was supposed to move towards Avdiivka to storm the Ukrainian city.
Another convict is a 33-year-old resident of the temporarily occupied city of Snizhne in Donetsk region. In the spring of 2023, he joined the 267th rifle battalion of the Russian army. After a short course of training at the training ground, the enemy accomplice was appointed a machine gunner and sent to the front line of the eastern front.
Based on the evidence, the court found him guilty under three articles of the Criminal Code of Ukraine:
- ч. 2 of Art. 111 (high treason committed under martial law);
- ч. 1 Art. 258-3 (participation in a terrorist group or terrorist organization);
- ч. 2 of Art. 260 (participation in paramilitary or armed groups not provided for by law).
The enemy shooter's actions were classified under two articles of the Criminal Code of Ukraine:
- paras. 1, 2 Art. 111 (high treason);
- ч. 7 of Art. 111-1 (providing assistance to the armed forces of the aggressor state in conducting hostilities against the AFU and other military formations).
