According to the investigation, with the assistance of the highest political leadership of the Russian Federation, officials of the pseudo-republic planned the deportation of children in advance, including from the "Teremok" orphanage, involving the management of the institution.
It was established that the "evacuation" was announced on February 18, 2022, but the corresponding appeal was recorded on February 16 - on the same day, an order was issued to transport them to the Rostov region of the Russian Federation. By a separate decision, the "Minister of Education" suspended the educational process and ordered to ensure the movement of children.
On February 18, the "head of the Donetsk administration" personally coordinated the removal of children from the institution. On the same day, 35 pupils were transported to the Russian Federation, and the director organized their departure and accompanied them during the transfer.
Currently, the children have not been returned to Ukraine, 12 of them have been handed over to families of Russian citizens.
The actions of the suspects are qualified as a violation of the laws and customs of war, committed by a group of persons by prior conspiracy (Part 2 of Article 28, Part 1 of Article 438 of the Criminal Code of Ukraine).
The UN Independent International Commission of Inquiry on Ukraine recognized the deportation of children from this institution, carried out before the full-scale invasion, as a war crime.
