Lawyer: NACP should check declarations of acting deputy head of the State Tax Service Sokur for their authenticity

The lawyer calls on the NACP to check the declarations of Yevhen Sokur for accuracy. For years, the acting deputy head of the State Tax Service did not indicate information about his cohabitant, which could lead to administrative or criminal liability.

The National Agency for the Prevention of Corruption should check the declarations of the acting deputy head of the State Tax Service, Yevhen Sokur, who allegedly did not declare information about his live-in girlfriend for years. This opinion was expressed by lawyer Oleksandr Baidyk in an exclusive commentary to UNN.

Context

Acting Deputy Head of the State Tax Service Yevhen Sokur entered allegedly false data in his 2023 declaration. In particular, he did not provide information about his partner in the document. During the investigation into the case of an alleged assassination attempt, Sokur himself told law enforcement officers that since 2016 he had been living with a girl named Alina in an apartment at 6-D Lobanovskoho Avenue. 

“This is a violation of the law, and there are grounds for the NACP to check it. The responsibility will not be greater, despite the fact that the violation is systematic. But it will still be there,” Baidyk said.

According to him, the NACP or even the NABU can conduct an audit based on a journalistic investigation.

“If this is proved, it will be either administrative or criminal liability, depending on the amount of money the partner has,” Baidyk said.

He explained that if the false information differs from the true information by 100 (302 800 UAH) to 500 (1 514 000 UAH) subsistence minimums, it is administrative liability. 

If the false information specified in the declaration differs from the true information by the amount of UAH 500 (1 514 000) to 4 thousand (12 112 000) of the subsistence minimum for able-bodied persons, this is criminal liability under Part 2 of Article 366 of the Criminal Code, punishable by a fine or community service with deprivation of the right to hold a position.

If the amount of the discrepancy is larger, the NABU should investigate the official.

Earlier, UNN reported that the attempted assassination of the acting deputy head of the State Tax Service of Ukraine, Yevhen Sokur, raises many questions about its authenticity. It could have been stagedto divert attention from the criminal proceedings against Sokur for abuse of office.

We are referring to criminal proceedingsopened on November 4, 2022 under Part 3 of Art. 365 of the Criminal Code of Ukraine, on the fact of abuse of office by the acting Deputy Head of the State Tax Service of Ukraine Yevhen Sokur, who on October 26, 2022 issued an order to revoke the license of PJSC Ukrtatnafta for the production of fuel. Such actions of Sokur, according to the investigation , caused serious consequences for the company and the state in the form of the inability to fulfill the mobilization tasks of the Ministry of Defense for the production and supply of petroleum products for the needs of defense and defense capability of the state.
