The Prosecutor General's Office has filed an appeal against the court decision that refused to invalidate the agreement with a private company. The prosecutor's office believes that the agreement creates a risk of illegal alienation of state property.

The Office of the Prosecutor General has filed an appeal against the decision of the Commercial Court of Kyiv, which refused to satisfy the claim to invalidate the agreement between the M. M. Hryshko National Botanical Garden of the National Academy of Sciences of Ukraine and a private company. This was reported by the Office of the Prosecutor General, as conveyed by UNN.

Details

The agreement in question was concluded in 2018 and provides for the reconstruction of real estate objects on the territory of the botanical garden. According to its terms, after the completion of the work, the majority of the reconstructed objects are to become the property of the private company.

In the opinion of the prosecutor's office, the implementation of this agreement creates a risk of illegal alienation of state property and lands of the nature reserve fund on which it is located. The State Audit Service of Ukraine also pointed out violations of legislation during its conclusion

In June 2026, the Commercial Court of Kyiv refused to satisfy the claim of the Specialized Environmental Prosecutor's Office. The court concluded that the disputed agreement does not contradict the interests of the state and society.

In turn, the prosecutor's office disagreed with this decision and insists on its cancellation through appeal.

The M. M. Hryshko National Botanical Garden is nearly 130 hectares of the nature reserve fund and a national landmark of garden and park art. It houses the famous Lilac Grove, and its plant collection is one of the largest in Europe. The botanical garden has exceptional environmental, scientific, and recreational significance.
