In Cherkasy region, an illegal order to lease a water fund land plot of more than 2.7 hectares for construction was canceled, returning the land to state ownership.
An unlawful order of the Cherkasy region administration to lease a water fund land plot of almost 2.7 hectares was cancelled by the Supreme Court of Ukraine. This was reported by UNN with reference to information from the press service of the Kyiv City Prosecutor's Office.
Details
A water fund land plot within the Kremenchuk Reservoir with an area of more than 2.7 hectares has been returned to the state. The Supreme Court upheld the cassation appeal of the Kyiv City Prosecutor's Office, thus canceling the illegal order of the Cherkasy Regional State Administration to lease a water fund land plot in Cherkasy region for construction.
For reference
Back in 2017, the water fund area of almost 2.7 hectares, which is located within the coastal protection zone of the Kremenchuk reservoir, was leased to a service cooperative for 10 years by the decision of the Cherkasy region's leadership.
The transfer of the land plot took place without complying with the procedure established by law - without changing the designated purpose of the water fund lands (artificial reservoirs) to recreational land.
In 2021, the Economic Court of Cherkasy Region upheld the prosecutor's claim in the interests of the state.
In October 2022 and December 2023, the Northern Commercial Court of Appeal overturned this decision and dismissed the claim.
The Kyiv City Prosecutor's Office twice appealed these rulings of the Northern Commercial Court of Appeal to the court of cassation.
In the end, the Supreme Court, thanks to the consistent and persistent position of the Kyiv City Prosecutor's Office, upheld the decision of the first instance court. The illegal order of the Cherkasy Regional State Administration on the lease of a water fund land plot in Cherkasy region for construction was canceled.
