What business expects and whether a productive dialogue with government agencies is possible: answered by the American Chamber of Commerce

Businesses are adapting to current realities, changing their approaches to planning, and establishing effective dialogues with authorities. Yuliia Borshch, Head of Legal Policy and Intellectual Property at the American Chamber of Commerce, spoke about this in an interview with UNN.

According to a recent survey conducted by the American Chamber of Commerce, after the rule of law, businesses expect enhanced national security and defense, as well as active demining of territories (47%), which is a basic prerequisite for business recovery and expansion. The predictability and stability of tax legislation (44%) are also important, as regulatory stability builds trust in the state as a partner.

According to Yuliia Borshch, issues of harmonization with European standards within the framework of European integration, as well as issues of employee reservation, employee safety and protection, and Russian missile strikes on critical infrastructure remain important.

However, as Yuliia Borshch emphasizes, the issue of the rule of law remains key. After all, it is this that allows for the effective provision and protection of investors' rights.

In this context, the issue of preventing unjustified pressure from law enforcement agencies on business is of fundamental importance for building investor confidence.

And work in this direction is underway. For example, as a result of systematic cooperation with the Office of the Prosecutor General, the Chamber addressed the Office regarding 70 individual appeals from member companies, of which 46 concerned pressure on businesses, and 24 concerned situations where companies suffered and sought justice.

As of today, investor rights have been protected in 36 appeals, and significant progress has been achieved in 19 cases, which is the maximum level of support within the powers of the Office of the Prosecutor General, including cases referred to court or to relevant authorized bodies. This cooperation demonstrates constructive development in the interaction between business and the law enforcement system and confirms that institutional dialogue can yield practical results.

The American Chamber of Commerce believes that consistent and systematic interaction between business associations and government agencies is one of the prerequisites for improving the business climate and strengthening investor confidence in Ukraine.

We, for our part, are grateful to the Office of the Prosecutor General for their support and openness to dialogue. At the same time, it is fundamentally important for us not only to maintain but also to strengthen this cooperation. We are convinced that the protection of investors' rights is our common priority, and we are ready to make every effort to achieve tangible and sustainable results.

At the same time, according to her, in wartime conditions, for a significant improvement in the business climate, it is crucial not only to respond to individual problems, but also to clearly concentrate on several systemic priorities that build trust and allow businesses to plan for the future, and in wartime conditions, businesses implement shorter planning horizons.

Businesses have already adapted by focusing on employee safety and operational continuity, active partnerships with stakeholders, hybrid work models, shorter planning horizons, and a scenario-based approach to decision-making. But for rapid and effective economic recovery, the state must now focus on creating stable, transparent, and predictable rules of the game so that Ukraine does not lose the window of opportunity to attract long-term investments in the future.

In September 2025, at the initiative of the Prosecutor General of Ukraine, Ruslan Kravchenko, the "StopPressure" portal was launched. This digital tool was created as part of state policy to protect businesses from unlawful interference in economic activity by law enforcement agencies. The portal allows company executives to report cases of pressure, undergo verification, classification, and ensures a systematic response to such facts.

Information provided through the portal is used to verify signals, initiate investigations, and bring perpetrators to justice in accordance with current Ukrainian legislation.

Earlier, the Prosecutor General noted that solving the problem of unlawful pressure on businesses by law enforcement agencies is one of the important priorities of his work. To implement this priority, a review of criminal proceedings against businesses was initiated. As of September 2025, following the review of over 23,000 criminal proceedings related to business activities, 35% of them were closed due to the absence of objective data regarding the elements and event of a criminal offense, as well as due to the lack of judicial prospects.

This is a large-scale effort aimed at protecting honest entrepreneurs and bringing to justice those who truly violate the law.
