Starting May 4, 2024, conscripts who had the status of "partially fit" must undergo a military medical commission to determine their fitness for military service. The military medical commission must be completed by February 4 inclusive, otherwise conscripts may face significant fines, UNN reports.
"Fit" / "unfit"
Law No. 3621-IX "On Amendments to Certain Laws of Ukraine Regarding the Provision of Social Protection Rights to Military Personnel and Police Officers," which came into force on May 4, 2024, abolished the statuses of "partially fit for military service" and "unfit for military service in peacetime, partially fit in wartime," and introduces only two statuses: "fit" and "unfit" for military service.
According to the law, citizens of Ukraine who were deemed partially fit for military service before the law came into force must undergo a re-medical examination within nine months to determine their fitness for military service, i.e., by February 4.
Earlier, UNN reported that in May last year, the Ministry of Defense, by its order, determined a list of diseases according to which the status of a conscript's fitness for military service would be established.
According to the order, military medical expertise will determine fitness for military service based on health status for conscripts, military personnel, reservists, establish the causal link of diseases, injuries (wounds, contusions, mutilations) with military service, and determine the need and conditions for the application of medical and social rehabilitation and assistance to military personnel.
According to the order, diseases are recognized by which a conscript can be recognized as:
- fit for military service with exclusion from registration, fit for service in support military units, TCC and SP, military educational institutions, training centers, institutions, medical units, logistics units, communications, operational support, security;
- unfit for military service, unfit for military service with re-examination in 6-12 months (the decision is made during martial law);
- requires release from official duties for a certain number of calendar days; leave for treatment due to illness for a certain number of calendar days; leave for treatment after injury (contusion, trauma or mutilation) for a certain number of calendar days; treatment in a healthcare institution for a period of at least a certain number of calendar days;
- temporarily unfit for training camps (the decision is made regarding conscripts, reservists called up for training camps); “temporarily unfit” for military service (indicate the date of re-examination).
However, in November, the Ministry of Justice registered an order of the Ministry of Defense, which amends the regulations of military medical commissions. In particular, the order stipulates that those unfit for military service will not be removed from the register and such persons will remain in the register of conscripts.
How to pass the military medical commission
According to the "Rules of Military Registration," approved by the Cabinet of Ministers, conscripts, military personnel, and reservists must report to the TCC within the deadlines specified in mobilization orders, summonses, and directives, respectively, for military registration and assignment for a special period, processing of military registration documents, undergoing a medical examination, referral for training to acquire or improve a military registration specialty, conscription for military service, or for training (verification) and special gatherings of conscripts and reservists.
Undergoing a military medical examination is only possible with a referral issued by the TCC. To issue a referral, the TCC must summon the conscript with a summons. If there was no summons, the conscript can personally contact the TCC to obtain a referral for the military medical commission.
In addition, the decision of the military medical commission on the degree of fitness of a conscript for military service during martial law is valid for 1 year, so conscripts need to update their medical information annually.
Fines
Failure to comply with the norm on timely passage of the military medical commission is a violation of military registration rules or legislation on defense, mobilization training, and mobilization.
According to the Code of Ukraine on Administrative Offenses (KUoAP), this may result in a fine of 17,000 to 25,500 hryvnias.
If a person with the status of "partially fit" does not undergo a re-examination by February 5, the electronic military registration document in "Reserve+" will remain unchanged. However, if the TCC sends a summons for a military medical commission, and the conscript does not comply with the terms of this summons, the status "wanted" will be displayed in Reserve+.
