Prosecutor General's Office launches criminal proceedings over demolition of historic Zelensky estate

The Prosecutor General's Office has launched a criminal investigation into the demolition of the Zelenskyy family's historic estate in Kyiv, which was under arrest. The facts of destruction of seized property and unauthorized construction are being investigated.

The OGP reported that under the procedural guidance of the Shevchenkivskyi District Prosecutor's Office of Kyiv, criminal proceedings were initiated over the destruction of the building at 22 Konys'koho Street (formerly Turgenivska).
The actions of the persons who destroyed the house are classified as destruction of seized property (Article 388(1) of the Criminal Code of Ukraine). Also, the fact of construction work in violation of the ban is being investigated, which is qualified as unauthorized construction on an illegally occupied land plot (Part 3 of Article 197-1 of the Criminal Code of Ukraine).
The prosecutor's office noted that the building at 22 Konysskoho Street was seized in January 2024 as part of criminal proceedings initiated over the intentional illegal destruction, destruction or damage to cultural heritage sites (Part 2 of Article 298 of the Criminal Code of Ukraine). The seizure provides for a ban on use, disposal and alienation.
The prosecutor's office added that they had requested the arrest because, according to the Kyiv General Plan, this site is part of the capital's historical area. Construction work requires a permit from the Ministry of Culture and Information Policy of Ukraine
Nevertheless, for a long time, construction work was carried out there, namely, capital construction, during which intentional illegal destruction, destruction or damage to cultural heritage sites is possible. The construction work was carried out without the appropriate approval of the Ministry of Culture and Information Policy of Ukraine. Therefore, due to the arrest of the building, all work had to be stopped. However, on July 19, 2024, despite the arrest, unidentified persons, in violation of the restrictive requirements, destroyed the building using heavy construction equipment
The Prosecutor General's Office added that the location of the equipment used in the demolition of the building has now been established. An emergency search was conducted on the territory where it was located, during which the equipment was seized. A motion for its arrest has been filed with the court.
