The President of Ukraine has signed a law on improving the institution of starostas. The document regulates the activities of starostas under martial law and amends the procedure for their appointment.

On Thursday, August 8, the President of Ukraine signed the law "On Local Self-Government in Ukraine" to improve the legal regulation of the institute of starostas and its activities under martial law." This was reported by UNN with a link to the document on the parliament's website.

This law aims to improve the legal framework for the functioning of the starosta institution in the context of full-scale armed aggression against Ukraine, the legal regime of martial law, and to eliminate the shortcomings in the current legislation of Ukraine regulating the relevant range of issues.

The law enshrines it:

  • the principle of omnipresence of starosta districts;
  • continuity of starostas' activities until newly elected local councils approve new starostas;
  • mandatory publication of the announcement of the start of public discussion of the starosta candidacy and information on its results;
  • the possibility of forming starosta districts consisting of one or more settlements with at least 200 inhabitants, if the population density in these communities is twice lower than the average population density in Ukraine;
  • starosta's right to a guaranteed speech at the meetings of the bodies of self-organization of the population, which are operating within the relevant starosta district.

During the period of martial law, the Law provides for a number of peculiarities of the functioning of the starosta institution, in particular:

  • Approval of starosta candidates at open plenary meetings of local councils without public discussions, but with subsequent publication of video recordings of such meetings;
  • sole appointment of the starosta by the head of the community in case the local council did not support three starosta candidates, the first two of which were submitted by the head of the community, and the third by at least half of the deputies of the total composition of the relevant council, as well as in case the council session is not held for more than three months without valid reasons;
  • appointment of temporary acting starostas by the head of the community in case of temporary absence of starostas due to their military service during mobilization and in some other cases;
  • the possibility of holding open meetings to hear starostas' reports to the residents of the starosta district via video conference.
