"Everyone has the right to professional legal assistance”: Lubinets reacted to the statements of the Volyn OTCC

The Ombudsman responded to the statements of the Volyn OTCC about the interference of lawyers in the mobilization processes. Lubinets stressed that according to the Constitution, everyone has the right to professional legal assistance, even under martial law.
The Verkhovna Rada Commissioner for Human Rights Dmytro Lubinets responded to the statements of the Volyn OTCC and the joint venture, in which they stated that lawyers should not interfere in the mobilization processes, emphasizing that according to Article 59 of the Constitution of Ukraine, everyone has the right to professional legal assistance, and the restriction of such a constitutional right is unacceptable, reports UNN.

According to Lubinets, recently the Volyn regional shopping center and joint venture commented on the story of one of the Volyn TV channels about the interference of lawyers in the processes of mobilization and medical examinations, saying that such procedures are specific and require knowledge of specialized aspects that only authorized persons and specialists have, and also added that the intervention of unauthorized persons, in particular lawyers, can disrupt the objectivity and independence of the processes of mobilization and medical examination, which are critical for national security.
A representative office in the Volyn region commented on this situation, recalling that according to Article 59 of the Constitution of Ukraine, everyone has the right to professional legal assistance. No one in Ukraine can be deprived of such a right, even under martial law. Yulia spas, my representative in the Volyn region, sent a corresponding letter to the Volyn regional shopping center and joint venture in order to explain and prevent violations of citizens ' rights
Igor Kolesnikov, Deputy Chairman of the committee for the protection of lawyers ' rights and guarantees of advocacy at the NAAU, also responded to this situation, noting that the position of the shopping center does not stand up to any criticism, and may also contain signs of a crime under Article 397 of the Criminal Code – interference in the activities of a defender or a representative of a person.
According to Article 59 of the Constitution of Ukraine, everyone has the right to professional legal assistance. In cases stipulated by law, this assistance is provided free of charge. Everyone is free to choose a defender of their rights, including those liable for military service. Restriction of such a constitutional right is unacceptable in accordance with Part 2 of Article 64 of the Constitution of Ukraine
