The head of the Novobavarian District Prosecutor's Office of Kharkiv filed a lawsuit in court in the interests of the state against a limited liability company to invalidate additional agreements to the goods purchase agreement. He demands the return of unreasonably paid budget funds.
The prosecutor's office established that in June 2023, an agreement was concluded between the municipal enterprise "Kharkiv Metro" and LLC for the purchase of fuel.
After a few months, the parties decided to change the value of the goods. They justified this with ten additional agreements.
It is noted that as a result of the conclusion of these agreements, the price per liter of fuel was increased. Thus, the cost of A-92 gasoline increased by 17.29%, A-95 - by 14.87%, diesel fuel - by more than 16%, liquefied petroleum gas - by almost half. At the same time, the volume of supply decreased, which essentially led to a complete leveling of the results of the purchase through the open tender procedure.
LLC refers to the price certificates of the Kharkiv Chamber of Commerce and Industry. However, they are not proper evidence of price fluctuations, since these documents only state the level of weighted average purchase and sale prices of goods for certain periods of time and do not prove its fluctuations
The prosecutor's office explained that the document on the price change must contain proper confirmation of the data set forth in it, conducted research on market fluctuations, sources of information, and other.
In general, the municipal enterprise excessively paid the unscrupulous supplier budget funds in the total amount of more than UAH 1.1 million. These violations of the law became the basis for the intervention of the prosecutor's office. The court of the Kharkiv region has opened proceedings in this case.
