The Ministry of Economy has denied rumors that the date of employment affects the possibility of reservations from mobilization. The criticality of the enterprise and a salary of UAH 20 thousand or more are the only mandatory criteria for obtaining a deferral.

Any date of employment of a person at an enterprise has nothing to do with the possibility of booking it. Now, two criteria are mandatory that an enterprise must meet: criticality and an appropriate level of wages. This was announced by Deputy Minister of Economy Vitaliy Kindrativ, commenting on the statements about May 18 during a telethon, UNN reports.

MP Bohdan Kitsak stated that in order to receive a reservation from mobilization, an employee had to be employed by the company until May 18, 2024.

When asked whether employees who are employed at the company later than May 18 will lose the opportunity to receive a reservation, Kindrativ replied: “Any date of employment of a person has nothing to do with the possibility of booking. The possibility of booking is determined by the criticality of the enterprise and the appropriate level of salary for the person who is planned to be booked. This date (May 18 - ed.) is indeed in the resolution and it was in the previous resolution, but it had a completely different logic.

Mr. Kindrativ noted that this date is for determining the percentage.

This is the date from which the formula calculated the number of people who can be booked. That is, it is for the percentage ratio. For example, before May 18, when this rule was integrated, an enterprise had, for example, 100 people on staff and they booked 50%. That is, they had 50 people booked, and 50 could potentially be mobilized. If 20 out of these 50 potentially mobilized people were taken away, the next iteration of booking would result in an estimated figure of 80% rather than 100%. It was this provision that fixed this possibility, that the company fixes a conditional quota for itself and 50% is counted from that date

In addition, Mr. Kindrativ explained what the company, which had previously been recognized as critical, needs to do to book its employees.

“We have now adopted a new resolution that defines the method and mandatory new criteria for determining criticality. That is, an enterprise that is already critical and already has employees booked needs to open the resolution and check whether it meets the new criteria and reapply to the body that determined their criticality - the regional military administration, or the relevant ministry, or the central executive body - and reapply, re-test, re-obtain criticality status,” Kindrativ said.

He noted that after that, the company will be able to continue to book new employees or change the structure of its booked people.

Currently, we have two mandatory criteria that a company must meet: the absence of any tax arrears and the average salary for the company and the salary for the employee who is booked. Both must be at least UAH 20 thousand

When asked whether, after the company confirms its criticality status, reservations that have not yet expired will be canceled, Kindrativ replied: “When an enterprise receives a new criticality, the body that determined the criticality enters it into the Diia system, and the head of the enterprise decides who he or she will rebook for the next term.

He noted that all current reservations will be valid until February 28. 

“That is, companies need to go through the procedure of re-confirming their criticality and re-book people according to the new procedure,” the deputy minister added.
