Supreme Court overturns prison sentence against former MP Solvar

The Supreme Court overturned the conviction of former MP Ruslan Solvar for compensation fraud and ordered a new trial, citing the incorrectness of the NABU and SAPO charges.

The Supreme Court has overturned the prison sentence against former Petro Poroshenko Bloc MP Ruslan Solvar and sent the case for a new trial on appeal. This is stated in the decision of the Joint Chamber of the Criminal Court of Cassation of the Supreme Court, reports UNN.

This is a case concerning compensation for the MP's rental expenses, which, according to NABU, he did not need.

The court of first instance found the MP not guilty of abuse of power. Then the judges decided that Solvar had committed fraud on a particularly large scale. However, since this crime is more serious than abuse of power, the court could not change the qualification on its own.

Instead, the HACC appeal found Solvar guilty. But not in abuse of power, but in abuse of office - for this he had to go to prison for three years. This did not happen, as Solvar first fled from the sentencing hearing, and then the Supreme Court suspended the execution of the sentence pending cassation proceedings.

The Supreme Court judges overturned the verdict of the HACC Appeals Chamber. The decision states that the NABU and the SAPO charged Solvar with abuse of power, not abuse of office. Therefore, the case should be reconsidered on appeal.

At the same time, the Supreme Court separately stated that the unreasonable accommodation of MPs in a hotel room should be qualified as an abuse of power. In fact, this is how the NABU and the SAPO qualified it.
