"Regarding the booking of employees of transportation companies. Let me remind you of the algorithm: an enterprise that meets the criteria submits a package of documents to the Ministry, receives the status of a critical one, and has the opportunity to book employees in Diia," Derkach wrote on Facebook.
He pointed out that "during this time, the Ministry has recognized about 170 carriers as critical, and about 80 more will soon receive this status." "Over the year and a half of the reservation mechanism's operation, we have received about 500 applications from carriers for criticality recognition (in 2023, no more than 40)," the official said.
At the same time, according to Derkach, there are a number of changes that carriers should be aware of:
- To obtain the status of a critical enterprise, a company must meet two out of seven criteria. Previously, three were required. Thanks to the amendments to the 76th resolution of the Cabinet of Ministers, it is easier for businesses to submit a package of documents. For example, it is necessary to have the appropriate license and not have any tax problems.
- Amendments were also made to Order 303 of the Ministry. The order has been signed and will be published after registration with the Ministry of Justice (we expect it next week). If a carrier has all the grounds to be recognized as critical without having to wait for the updated 303rd Order, then, according to the carrier, it can apply now.
Among the key changes in the order:
- Expanding the list of companies that can apply for criticality recognition. These are carriers providing irregular transportation and bus stations.
- Companies that carried out transportation not only in 2022, but also those that started operations in 2023 and 2024 can apply.
- Abolition of the need to confirm the formalization of labor relations with employees 180 days before submitting documents. According to him, there is an understanding that companies are hiring new employees in the face of staff shortages, so waiting 180 days is unjustified.
He emphasized that all amendments to Order 303 will come into force after the act is registered by the Ministry of Justice. "In practice, this means that it is possible to submit packages of documents to the Ministry taking into account these changes only after the updated order comes into force," he said.
"Regarding the booking of private entrepreneurs. Currently, no individual entrepreneur, not only carriers, but, for example, farmers or builders, can receive critical status. According to the Ministry of Economy, this is contrary to the law. Therefore, only amendments to the law that will allow not only "enterprises, institutions, organizations" to book flights can remedy this situation, the Deputy Minister said.
