Rada Adopts Changes to the Procedure for Consideration of Cases in the HACC: What is it about

The Parliament adopted a draft law that changes the procedure for reviewing cases in the High Anti-Corruption Court, allowing for a one-person review of most cases, except for cases against high-ranking officials at the request of the accused in some cases.

 The Verkhovna Rada at today's session adopted as a whole the government's draft law No. 11130, which changes the procedure for consideration of cases in the High Anti-Corruption Court (HACC) and clarifies the composition of the court in cases against high-ranking officials, UNN reports, citing MP Yaroslav Zheleznyak and the draft law. 

The Parliament adopted immediately as a whole No. 11130 on partial one-person consideration of cases in the HACC vs. collegial consideration if the accused is a top official.FOR - 286

As UNN reported , if earlier the case was considered in the first instance by a panel of three judges, now it will be heard by a single judge.

At the same time, as Zheleznyak pointed out, it is possible to consider cases by three judges only at the request of the accused, if:

  • The charged crime is punishable by imprisonment for a term exceeding 10 years;
  • criminal proceedings against the President of Ukraine, whose powers were terminated, MP of Ukraine, Prime Minister of Ukraine, member of the Cabinet of Ministers of Ukraine, Prosecutor General, Head of the Security Service of Ukraine, member of the National Council of Ukraine on Television and Radio Broadcasting, National Commission on Securities and Stock Market, National Commission for the State Regulation of Electronic Communications, Radio Frequency Spectrum and Postal Services, National Commission for the State Regulation of 

As the government's representative in parliament, Taras Melnychuk, noted , the draft law is part of the Ukraine Facility Program Implementation Plan and "aims to improve legislation to fight corruption more effectively in terms of increasing efficiency and ensuring proper judicial review of criminal proceedings.
