Today, the Supreme Court refused to satisfy the complaint of MP Oleksandr Dubinsky to recognize the inaction of the parliament in not calling the presidential election in Ukraine as illegal, UNN reports.
The decision was made by a panel of judges of the Administrative Court of Cassation as part of the Supreme Court.
Dubinsky demanded that the inaction of the Verkhovna Rada in not calling the presidential election and the obligation of the Verkhovna Rada to call the presidential election by adopting a resolution be recognized as "unlawful". This request was denied.
As a reminder, the five-year term of office of President of Ukraine Volodymyr Zelenskyy, as defined by the Constitution, expired in the spring of 2023. Under normal circumstances, the first round of elections would have been held in March, and the second round, if necessary, in April. However, due to the martial law, the elections were not scheduled, according to Article 19 of the Law on the Legal Regime of Martial Law. Dubinsky tried to challenge this in his lawsuit.

On November 13, 2023, MP Oleksandr Dubinskyi was notified of being suspected of high treason and participation in a criminal organization. On November 14, the Pecherskyi District Court of Kyiv imposed a pre-trial restraint on Dubinskyi in the form of detention.
The investigation established that he had the call sign "Pinocchio" and was a member of a criminal organization formed by the General Staff of the Russian Armed Forces.
He spread fake news about Ukraine's top military and political leadership. In particular, about the alleged interference of Ukrainian officials in the 2019 US presidential election. The criminal organization he was a member of also aimed to undermine the socio-political situation in Ukraine.
In 2024, the SBI completed an investigation into high treason by members of a criminal organization that included Dubinsky. The case was referred to the court.
The investigation established that he, former MP Derkach and former prosecutor Kulyk, on the instructions of Russian special services, organized events to discredit Ukraine's image in the international arena in order to deteriorate diplomatic relations with the United States and complicate Ukraine's accession to the European Union and NATO.
The MP is also suspected of official forgery for traveling abroad and illegal transportation of other persons across the state border.
