The company xAI of American billionaire Elon Musk has filed a lawsuit against the authorities of the state of Minnesota over a law that prohibits the use of artificial intelligence technology to create fake nude images of real people. This is reported by the Associated Press, writes UNN.

The lawsuit was filed in federal court a few days before the law takes effect. If the document comes into force, Minnesota will become the first US state to introduce such a ban. The law was signed in May.
xAI stated that they support the fight against the spread of AI-generated intimate images without a person's consent, but believe the law is too broad and violates constitutional rights to freedom of speech.

The company claims that the document even applies to images created with a person's consent or by the person themselves, and also does not contain a "safe harbor" provision for platforms that make good-faith efforts to prevent the appearance of such content. Additionally, each violation carries a fine of $500,000.

Minnesota Attorney General Keith Ellison said he has not yet reviewed the lawsuit, but emphasized that creating nude images of people using artificial intelligence without their consent is unacceptable and can cause serious emotional, personal, and professional harm.
As AP notes, US courts have already issued various rulings on state laws regulating the use of deepfakes. In particular, a similar California law was blocked due to freedom of speech concerns, while the Minnesota law had previously survived a court challenge in 2025.
