The Specialized Anti-Corruption Prosecutor's Office and the National Anti-Corruption Bureau of Ukraine have exposed a Ukrainian Armed Forces official for receiving an unlawful benefit from a developer. This was reported by UNN with reference to SAPO.
Details
It concerns a former head of one of the territorial departments of the Military Law Enforcement Service of the Ukrainian Armed Forces, who simultaneously held the position of commander of a military camp in Lviv.
The investigation established that in 2021, the suspect, while holding these positions, offered a developer assistance in the construction of a multi-apartment residential building on the territory of the military camp. The official involved accomplices in the scheme and wanted to receive $2.2 million US dollars for his "services", as well as additional real estate worth over 4 million hryvnias.
Of this amount, $1.5 million US dollars was to be received directly by the Ukrainian Armed Forces official, part of which he planned to transfer to members of the Cabinet of Ministers of Ukraine for approving a joint activity agreement between the developer and the military unit under his command. The remaining $700,000 US dollars was planned to be divided among the accomplices in the scheme - a former lawyer and another developer
The official's actions are classified under Part 4 of Article 368 of the Criminal Code of Ukraine (Acceptance of an offer, promise, or receipt of an unlawful benefit by an official). The penalty provides for imprisonment from eight to twelve years with deprivation of the right to hold certain positions or engage in certain activities for up to three years, with confiscation of property.
Also, in connection with the committed act, a suspicion has been notified to the developer (Part 4 of Article 369 of the Criminal Code of Ukraine) and the accomplices in the scheme (Part 5 of Article 27, Part 4 of Article 368 of the Criminal Code of Ukraine). This concerns an offer, promise, or provision of an unlawful benefit to an official holding a particularly responsible position, or if such actions are committed by an organized group of persons, as well as aiding or other types of complicity in particularly large-scale bribery or receipt of an unlawful benefit by an official holding a particularly responsible position, or combined with extortion.
The penalty under the articles provides for imprisonment from 3 to 10 years.
