Prosecutor's Office in Ternopil Opens Proceedings Over Violations of Citizens' Rights at TCC

The Prosecutor's Office has opened criminal proceedings regarding the violation of rights and illegal detention of individuals at the Ternopil TCC. Five men who were not subject to conscription have already been released.

The Ternopil Specialized Prosecutor's Office in the Defense Sphere of the Western Region has opened criminal proceedings following complaints of violations of citizens' rights at the Territorial Recruitment and Social Support Center (TCC). This was reported by UNN with reference to the Office of the Prosecutor General.

Details

Information has been entered into the Unified Register of Pre-trial Investigations under Part 2 of Art. 146 of the Criminal Code of Ukraine (Illegal deprivation of liberty or abduction of a person). The sanction of the article provides for restriction of liberty for up to five years or imprisonment for the same term.

As noted by the prosecutor's office, the grounds were the results of a monitoring visit by representatives of the Verkhovna Rada Commissioner for Human Rights to the Ternopil District and City TCC and SP, as well as materials provided by the Military Law Enforcement Service.

According to the released information, about 28 people were in the TCC premises during the visit. 17 of them reported possible violations of their rights in writing. It was also established that among the persons in the TCC were citizens who, according to preliminary data, were not subject to mobilization. In particular, a man with a lifelong Group II disability since childhood, persons with mental disorders, as well as citizens who had actually reached the age limit for military registration. As a result of the inspection, five such persons were released

Context

The Verkhovna Rada Commissioner for Human Rights, Dmytro Lubinets, stated that the Ternopil District and City TCC and SP have been holding people with mental disorders and disabilities for a long time. He added: thanks to the intervention of his representatives in the Ternopil region, 5 people who were not subject to mobilization were released.
