The National Bank of Ukraine has deemed Ihor Smilianskyi as not meeting the requirements for professional suitability. The regulator demands that Ukrposhta suspend him within five days.

The National Bank of Ukraine has decided that the CEO of JSC "Ukrposhta" Ihor Smilianskyi does not meet the requirements and demands the government dismiss him. This is stated in the NBU statement dated June 23, reports UNN.

"The National Bank of Ukraine has decided that the CEO of JSC "Ukrposhta" Ihor Yukhymovych Smilianskyi does not meet the professional suitability requirements established for the head of a financial payment service provider. The decision was made by the Committee on Supervision and Regulation of Banking Activities and Payment Infrastructure Oversight," the statement reads.

It is noted that the NBU initiated the procedure for assessing Smilianskyi's compliance with professional suitability requirements based on the results of the NBU's supervisory actions regarding the company's activities in 2023-2026.

"During this period, the regulator repeatedly applied influence measures (written warnings and fines) to JSC "Ukrposhta" in connection with violations in the field of payment services, financial monitoring, as well as due to shortcomings in the risk management and internal control system. Based on the results of the interview and analysis of available materials, the NBU Qualification Commission concluded that there are grounds to recognize Ihor Smilianskyi as not meeting the professional suitability requirements established for the head of a financial payment service provider," the NBU stated.

Also, the NBU noted that "taking into account the information on identified violations in the activities of 'Ukrposhta', as well as the answers and explanations provided by Smilianskyi during the interview conducted with him, the Committee concluded that he does not have a sufficient level of knowledge of legal requirements, understanding and experience in the proper application of current legislation, including regulatory acts of the National Bank, to the extent necessary for the proper performance of his duties, which indicates his non-compliance with the professional suitability requirements as the head of a financial payment service provider."

"In view of this decision, in compliance with legal requirements, JSC 'Ukrposhta' through its authorized body must take all necessary actions to replace the CEO and bring its activities into compliance with the requirements of Ukrainian legislation and regulatory acts of the National Bank. Thus, within five working days, the authorized body of JSC 'Ukrposhta' must suspend Ihor Smilianskyi from management, and then within two months – appoint a new head who meets the professional suitability requirements," the NBU summarized.

Addendum

Ihor Smilianskyi was appointed CEO of JSC "Ukrposhta" in July 2016, and on August 17, 2018, a new three-year contract for this position was signed with him.

In June 2021, the Supervisory Board of Ukrposhta extended Smilianskyi's powers as head of Ukrposhta until June 30, 2023, and later until the end of wartime plus 3 months.
