In fact, the path for Trump to run for a third term - and possibly a fourth by January 2037, when he turns 90 - is not only possible, but simple, thanks to a clear loophole in the amendment.
It is noted that the implementation of this goal will not require an army of lawyers, instead, this step will depend only on the interpretation of one word - "elections" - in the 22nd Amendment and the loyalty of one person - US Vice President J.D. Vance. In addition, Trump needs to have enough public support to win a third term in the elections.
The full text of the 22nd Amendment reads as follows: "No person shall be elected to the office of the President more than twice, and no person who has held the office of President, or acted as President, for more than two years of a term to which some other person was elected President shall be elected to the office of the President more than once."
"The loophole in the 22nd Amendment is outlined in a 1999 Minnesota Law Review article co-authored by Professor Bruce Peabody titled "Twice Elected and the Future President." It explains how the amendment caused "widespread misunderstanding" and concludes that the idea that any twice-elected president is "constitutionally barred" from holding office again is "undoubtedly incorrect."
According to the article: "We argue that the 22nd Amendment only prohibits the re-election of a president who has already been elected twice." The key phrase of the amendment is "No person shall be elected to the office of the President more than twice...". It is argued that this means that a twice-elected president would not be prohibited from later assuming office again due to the resignation or death of another president.
Thus, Trump could run for Vice President, and Vance, as an openly recognized nominal figure, for President. When he takes the oath, Vance can resign, allowing his Vice President Trump to lead the country.
