On the eve of the court hearing in the case of Adnan Kivan's death, the accused doctor Vitaliy Rusakov intensified his public campaign. He sharply criticizes the court and calls on fellow doctors to attend the hearings, trying to present his own case as one that will allegedly affect "every doctor in the country." Such rhetoric raises questions about Rusakov's possible attempts to influence the course of the trial by exerting pressure, UNN reports.
Today, April 3, another hearing in the case of medical negligence that may have caused the death of businessman Adnan Kivan is to take place in the Primorsky District Court of Odesa.
On the eve of the hearing, doctor Vitaliy Rusakov, who is accused in the case, intensified public communication around the process. In particular, he called on "all concerned citizens" to come to court and support him. Such a call looks not like ordinary informing, but like an attempt to gather a support group in the courtroom and create additional pressure on the court.
At the same time, Rusakov openly criticizes the court and its decisions in his vlogs and publications. In particular, he states that the process is allegedly "being closed off from society." This statement is false, as at the last hearing the court decided on a partially open hearing – with a restriction on broadcasting only during the announcement of the patient's medical data.
This approach directly complies with the norms of the Criminal Procedure Code of Ukraine. In particular, the law provides for the possibility of closed or partially closed court sessions in cases where circumstances containing medical secrets, personal data, as well as cases related to intimate circumstances, in particular sexual crimes, are considered.
Therefore, the restriction of the openness of the process in this case is not an "hiding of the truth," as Rusakov presents it, but a standard legal practice aimed at protecting private information and human dignity. Despite this, Rusakov presents the situation as an attempt to "hide the truth," actually distorting the essence of procedural decisions.

The tone of the doctor's public statements also attracts additional attention. In his vlogs and publications, Rusakov allows himself sharp formulations addressed to the court and the process, which can be perceived as disrespect for the institution of justice.
Moreover, he creates visual materials depicting the presiding judge in the case, Larysa Pereverzieva, accompanying them with mocking and critical captions. Such an approach goes beyond a restrained legal position and, together with calls to support Rusakov in the courtroom, only reinforces the impression of attempts to pressure the court.

As UNN previously wrote, Rusakov also publicly voices details of his deceased patient's condition, the course of treatment, and other medical data, which raises questions about his adherence to medical confidentiality and the Ethical Code of a Doctor of Ukraine.
