Court changes restrictive measure for MP Yurchenko, accused of bribery

HACC has prohibited MP Yurchenko from leaving the Kyiv region until June 30. The court refused to forfeit 3 million hryvnias to the state budget.

The High Anti-Corruption Court has changed the measure of restraint for People's Deputy Oleksandr Yurchenko in a bribery case. Yurchenko must not leave the boundaries of the Kyiv region until June 30, UNN reports.

Thus, the court changed the measure of restraint for Yurchenko, according to which the MP must not leave the boundaries of the Kyiv region until June 30, but the court denied the motion to collect 3 million hryvnias in favor of the state. 

Addendum

On August 11, 2021, the SAPO and NABU sent the indictment of Yurchenko and his intermediary to court, who are accused of receiving an improper benefit and inciting the provision of such a benefit. 

In the summer of 2020, the National Bureau received operational information about the existence of an organized group whose members receive improper benefits for using the legal powers of People's Deputies of Ukraine. To identify all members of the criminal group and promptly document their activities, NABU developed a special operation to uncover the criminal activities of the organized group and include an "undercover" detective in its composition.

As part of the specified special operation, the "undercover" detective played the role of a representative of a foreign company. After meeting one of the group members, the detective informed him that a condition for investing in Ukraine was the adoption of several legislative initiatives regarding the provision of a "green tariff" for the sale of electricity to waste disposal enterprises and other regulatory adjustments to the enterprise's activities.

According to the investigation, the crime participant then introduced the detective to a People's Deputy of Ukraine. During subsequent meetings, the people's representative requested an improper benefit in the amount of 13,000 USD through an intermediary for introducing proposals to the draft law of Ukraine "On Waste Management" and later another 200,000 USD to bribe People's Deputies who are members of the relevant Committee of the Verkhovna Rada of Ukraine.

In early August, the "undercover" detective handed over an improper benefit in the amount of 13,000 USD for introducing proposals through an intermediary. On August 26-27, the accomplices planned to receive funds in the amount of 200,000 USD, including for bribing People's Deputies. However, the National Bureau was forced to terminate the further execution of the special task because the crime participants were informed about the documentation of their activities, simultaneously changing their mobile operator subscriber numbers and mobile terminals.

According to the findings of expert examinations, all audio and video recordings obtained during the covert investigative (search) actions conducted regarding the People's Deputy of Ukraine and his accomplice show no signs of editing or forgery, and the statements made in these video recordings belong specifically to the people's representative and the second co-executor of the crime.

Despite all attempts by the People's Deputy and his accomplice to disguise the request for an improper benefit and the subsequent incitement to transfer money to other deputies, the conclusion of a forensic semantic-textual (linguistic) examination confirmed the presence in the defendants' statements of a request for the provision of funds as an improper benefit and their inducement of the "undercover" NABU detective to provide an improper benefit to members of the relevant committee of the Verkhovna Rada of Ukraine.

The intermediary in the transfer of the improper benefit (an unofficial assistant to the MP) was notified of suspicion by NABU and SAPO on September 10, 2020. The MP himself was notified later—on September 17, after the Prosecutor General signed the suspicion.

A SAPO prosecutor applied to the court with a motion to change the measure of restraint for People's Deputy Oleksandr Yurchenko, who is accused of receiving an improper benefit and inciting the provision of such a benefit. The prosecutor's office insists on applying a measure of restraint in the form of detention to the accused.
