Former Kyiv City Council deputy Aryeva received a suspended sentence for a car accident - the prosecutor's office will appeal

Former Kyiv City Council deputy Yaryna Arieva, who was accused of causing a serious road accident while under the influence of drugs, received a suspended sentence. The prosecution will appeal the court's decision, the Kyiv City Prosecutor's Office told UNN.

The court sentenced the accused to 5 years of imprisonment with a 3-year ban on driving vehicles. Based on Article 75 of the Criminal Code of Ukraine, the woman was released from serving her sentence with a probationary period of 3 years. Therefore, disagreeing with this court decision, the prosecution will appeal it.

As reported by the capital's prosecutor's office, "the prosecution believes that the driver committed the accident while under the influence of drugs." "This position is based on the conclusion of a narcologist who examined her after the accident, and the results of a toxicological examination, which confirmed the presence of cannabis metabolites in the accused's body," the prosecutor's office noted.

As noted by the capital's prosecutor's office, given this, the prosecutor asked the court to find the driver guilty under Part 2 of Article 286-1 of the Criminal Code of Ukraine and sentence her to 6 years and 6 months of imprisonment, depriving her of the right to drive vehicles for 8 years.

"At the same time, the court, having found the woman guilty of committing a road accident, reclassified her actions from violating traffic safety rules by a person driving a vehicle while under the influence of drugs (Part 2 of Article 286-1 of the Criminal Code of Ukraine) to an article that provides for punishment for violating traffic rules without being under the influence of drugs (Part 2 of Article 286 of the Criminal Code of Ukraine)," the prosecutor's office reported.

On November 27, 2022, a road accident occurred in Kyiv involving former Kyiv City Council deputy Yaryna Arieva. On June 19, the court placed the suspect under round-the-clock house arrest.

Arieva herself stated that she was not under the influence of drugs, and also that she hit a woman in the dark, during a period when power outages were ongoing throughout the country and the accident site was not illuminated. However, the prosecutor's office reported that the results of the examination confirmed the presence of cannabinoids in the deputy's blood.

On June 20, 2023, she submitted a statement to resign her mandate as a deputy.

In July 2023, the indictment against former Kyiv City Council deputy Yaryna Arieva was sent to court.
