Today, the court did not hold a court hearing in the case of the former acting commander of one of the units of the Special Operations Forces, Roman Chervinsky, and did not extend his detention . According to the lawyers, judges may try to arrest the defendant without a trial. This was reported on Facebook by the military's lawyer Konstantin Globa, according to UNN .
Details
Globa noted that there are two options for the following developments.
According to the first one, the prosecutor will take responsibility and issue a decision to extend Roman's detention without a court hearing.
According to the second possible option, the judges will issue something like a ruling without holding a court hearing, where, in Globa's opinion, it will be written that the term of detention will be extended.
In both cases, they will be guided by Part 5 of Article 615 of the CPC of Ukraine, but the defense believes that such actions are illegal and will be met with a corresponding response. The judges are currently locked in court. Our client is also in court and is playing ping pong with accepting responsibility.
The lawyer also noted that the court itself refused to consider the case and hold a hearing. Representatives of the themis referred to air raids, but the defense categorically rejected these arguments.
The court itself refused to consider the case and hold a hearing! Nothing prevents the court from holding it now, even the members of the court are in court with Roman! There are no air raids! I appealed to the court with a demand to start the trial now. Under such circumstances, the provisions of Article 615 of the Criminal Procedure Code cannot be applied!
Recall
At the beginning of the month Shevchenkivsky District Court extended the detention without bail until April 19 for the former acting commander of one of the Special Operations Forces units Chervinsky. It was noted. It was noted that for the first time in the consideration of this case, the court did not favor the prosecution.
Context
The SBU detained the former acting commander of one of the units of the Special Operation Forces, Roman Chervinsky, in the case of the rocket attack on Kanatove airfield. He is accused of having arbitrarily decided to conduct a special operation with his accomplices to seize an aircraft of the Russian Aerospace Forces. To do this, they entered into negotiations with Russian pilots, one of whom agreed to go over to the side of Ukraine.
As a result, the enemy received information about the deployment of the Ukrainian Air Force personnel and Ukrainian aircraft at the Kanatove airfield. This allowed the Russian Armed Forces to launch missile attacks on the Kanatove airfield in Kirovohrad region in the summer of 2022.
However, Roman Chervinsky claims in his comments to the media that this operation was agreed upon by the Ukrainian special services.
