Vinnytsia Regional Council Deputy Appeals to Prosecutor's Office on Legality of Dismissal of Director of Center for Infectious Diseases

The legality of the dismissal of Ihor Matkovsky , director of the Center for Infectious Diseases in Vinnytsia, is to be checked by the prosecutor's office. Despite the martial law, the decision to extend the contract or dismiss the director should have been made by the deputies by voting at the session, and not by the head of the region Vyacheslav Sokolovyi alone. This opinion was expressed by Yevhen Shapovalov, a deputy of the Vinnytsia Regional Council from the Servant of the People party, in an exclusive commentary to UNN.

 I appealed to the regional prosecutor's office for legality. Let them deal with the conclusions. In my personal opinion, as a lawyer, such a decision, despite the legal regime of martial law, should still be made either at a session of the regional council, according to the Law on Local Self-Government. Or, if we're talking about some kind of sole decision, by order of the director of the Department of Health and Rehabilitation of the regional military administration. Because the department is an executive body 

,Shapovalov said.

According to the deputy, the head of the regional council can appoint managers in the council's apparatus alone. As for other positions, it is necessary to bring the issue to the session hall and discuss it. Especially since the "Groysman's Ukrainian Strategy," which is represented by the chairman of the regional council, Vyacheslav Sokolovy, already has a majority.

"Reading the preamble of the orders of the head of the regional council, it was a little strange for me, because they refer to the norm of certain transitional provisions that are in force during martial law.  But the law first mentions the subject of the appointment, and then that the head of the regional council can appoint an acting head without a competition. In my opinion, people who work in the executive office of the regional council, in some departments, can be appointed by the order of the head of the regional council without a competition. Fortunately, Vinnytsia is not close to the front line, so it is not a problem to convene a session and vote. Especially if there is a steady majority of Groysman's Ukrainian Strategy in both the relevant committee and the session hall," the deputy added.

Shapovalov emphasizes that if this issue had been considered at the session, it might not have passed if the MPs had seen any undercurrents.

"When there are logical and understandable arguments, they can stop deputies from making certain decisions. I mean, if the issue of dismissal or appointment of a candidate is clearly ambiguous, it will be very difficult to get through the session," Shapovalov summarized.

Recall

In Vinnytsia region, Ihor Matkovsky, the longtime director of the Clinical Center for Infectious Diseases, was dismissed with a scandal.  The decision was made in late September by Vyacheslav Sokolovyi, the head of the Vinnytsia regional council from Groysman's Ukrainian Strategy, who took advantage of martial law.

Matkovsky was "accused" of buying a CT scanner for the Center with money raised from the sale of fuel and lubricants confiscated from Russian owners. The ex-director himself hints that his dismissal may be related to the fact that someone is interested in 84 hectares of the Center's land, three kilometers from Vinnytsia.
