Rules for enforcement proceedings are changing in Ukraine. Law No. 4833-IX provides for the digitalization of part of the processes, faster exchange of information between banks, registries, and enforcement officers, as well as the automation of certain procedures. Anastasiia Tsykalo, chief lawyer in the field of administrative law at LLC "LOGIC Law Firm," told UNN about this in a comment.
One of the main changes will be the strengthening of the role of the Unified Register of Debtors. Now, information in the register can affect the possibility of selling property, re-registering a car, or formalizing collateral or a mortgage.
According to the lawyer, the law deepens the already existing digital system of enforcement proceedings.
The automated system of enforcement proceedings was already used for electronic interaction and data exchange. However, Law No. 4833-IX expands its functionality, strengthening the connection with the Unified Register of Debtors, banks, financial institutions, non-bank payment service providers, and other registries
Separately, the law concerns electronic money and electronic wallets. Enforcement officers will be able to obtain broader information about the debtor's financial assets, and the seizure will apply not only to bank accounts.
The law also allows for the seizure of funds belonging to third parties if they have a confirmed debt to the debtor. This is intended to simplify the actual recovery of funds in enforcement proceedings.
Another important change is the automatic removal of seizures after the debt is repaid. After the funds are received, the system should automatically generate a notification of debt closure and update the data in the registries.
As Tsykalo explains, the innovations are intended to make the execution of court decisions faster and the system itself more digital and transparent.
That is, the emphasis is shifting from individual electronic tools to a more comprehensive digital model of decision enforcement, in which data about the debtor, their assets, and the status of the decision's execution should be processed faster and in a more coordinated manner
