The Commercial Court of Kyiv declared the auction for the sale of a special permit for granite extraction illegal due to anti-competitive actions of participants. The purchase and sale agreement and the permit itself have been canceled.

The Commercial Court of Kyiv declared the results of the auction for the sale of a special permit for subsoil use of one of the most promising granite deposits in the Zaporizhzhia region illegal. The court also canceled the purchase and sale agreement and the special permit itself, reports UNN citing the Office of the Prosecutor General.

Following a lawsuit by the Office of the Prosecutor General, the court invalidated the results of the electronic auction for the sale of a special permit for subsoil use, the purchase and sale agreement concluded based on its results, and the special permit itself

According to the prosecutor's office, in 2021, the State Service of Geology and Subsoil of Ukraine put up for auction a special permit for granite extraction for a period of 20 years. The deposit, covering an area of 20.5 hectares, contains about 9 million cubic meters of high-quality granite and is considered one of the most promising in the region due to its significant reserves and developed transport infrastructure.

The Office of the Prosecutor General noted that two auction participants submitted identical starting bids, and the winner raised the price by only 1.8%.

The bidders did not compete with each other but coordinated their actions, thereby distorting the auction results. These circumstances were confirmed by a decision of the territorial body of the Antimonopoly Committee of Ukraine

The prosecutors added that the court agreed with their arguments and concluded that the auction, the concluded agreement, and the issued special permit are illegal because "anticompetitive concerted actions deprived the state of the opportunity to obtain a fair competitive price for the right to use the subsoil."
