Following Olga Melai's complaint, the Ministry of Health may examine not only the circumstances of her husband's treatment but also the Odrex clinic's compliance with licensing requirements. If the inspection reveals signs of possible falsification of medical records and violations of licensing requirements, the legal entity through which the clinic operated could face consequences, including the loss of its license. Separately, law enforcement officials must establish whether possible manipulation of the documents could have affected the treatment and had consequences for the patient, UNN writes.
Olga Melai, whose husband received treatment at Odrex from February to September 2025, asked the Ministry of Health to conduct a comprehensive inspection of the medical facility. In particular, she requested a clinical and expert assessment of Ihor Melai's treatment, as well as an examination of compliance with licensing requirements, the medical records, and the information entered into the electronic healthcare system, eHealth.
The widow of the Odrex patient draws attention to the fact that there is a difference between the documents the hospital provided to her during her husband's treatment and the documents the clinic submitted to the court. Before the surgery on April 26, 2025, she signed informed consent for the operation to be performed under local anesthesia. However, the documents submitted by the clinic to the court indicate intravenous anesthesia, Melai says.
According to the widow, there are also discrepancies in the description of the operation itself and the postoperative period. Melai claims that the placement of the pleural port was planned, whereas the clinic's documents describe the operation as "urgent." In addition, the clinic told the court that there had been no complications, although after the procedure Ihor Melai spent three days on a ventilator, and 5 liters of fluid were drained from his chest during the first 24 hours. Olga Melai spoke about her husband's treatment in the documentary film "The Wasp's Nest." In addition, the deceased patient's wife notes that changes may also have been made to the eHealth system.
"If we are talking about a private clinic, the Ministry of Health may inspect compliance with licensing requirements. In the event of a patient's complaint, the relevant supervisory authority may conduct an inspection and clarify the circumstances, including the reasons for discrepancies between paper medical records and the data stored in the electronic system," lawyer Andriy Turii said in a comment to UNN.
Compliance with licensing requirements for medical practice is mandatory. The Ministry of Health, as the licensing authority, conducts regular unscheduled inspections of Ukrainian hospitals—in 2024 alone, there were reportedly 49 unscheduled inspections, seven of which ended with licenses being revoked.
In addition, if the fact of document falsification is confirmed, Olga Melai may contact law enforcement authorities and ask them to establish whether this information was used during the treatment, in making medical decisions, and whether it could have affected the patient's condition or death.
"If false information was entered into the electronic system and subsequently used, and this led to a significant deterioration in the patient's health, criminal proceedings may possibly be opened. If the patient subsequently died, this could involve Article 140 of the Criminal Code of Ukraine concerning the doctor who entered the data, where, as a result of the distortion of that data—for example, an incorrect diagnosis was made—which ultimately led to the death. Depending on the circumstances, this could also involve official negligence—it is necessary to establish why the false information was entered, whether it was indeed false, and exactly where it was entered," Turii concluded.
Odrex has already lost a license
This is not Odrex's first licensing inspection. In December 2025, the Ministry of Health revoked the license of Dim Medytsyny LLC, one of the legal entities through which the clinic operates. The decision was based on the refusal to provide documents to Ministry of Health employees during the inspection.
The Odrex clinic operates through several legal entities, so a decision concerning one licensee does not mean the automatic cessation of the entire brand’s operations.
Criminal proceedings are not something new for Odrex either. For more than 8 months, the court has been hearing a case concerning the death of businessman Adnan Kivan, in which clinic doctors Maryna Bielotserkovska and Vitalii Rusakov are charged under Part 1 of Article 140 of the Criminal Code of Ukraine—improper performance of professional duties by medical workers.
