The Cabinet of Ministers approved a bill that increases administrative fines for violations of financial legislation and extends the limitation period for holding violators accountable to one year. The Ministry of Justice reports this, UNN writes.
The government approved a bill developed by the Ministry of Finance to strengthen liability for violations of financial legislation
The document provides for amendments to Articles 38 and 164 of the Code of Ukraine on Administrative Offenses.
Currently, fines for the relevant violations are:
- for the first violation - from 136 to 255 hryvnias, or 8–15 non-taxable minimum incomes of citizens;
- for a repeated violation within one year - from 170 to 340 hryvnias, or 10–20 non-taxable minimum incomes.
If the bill is adopted, the fines will increase:
- for the first violation - to 850–1,190 hryvnias, or 50–70 non-taxable minimum incomes;
- for a repeated violation within one year - to 1,020–1,360 hryvnias, or 60–80 non-taxable minimum incomes.
For calculating administrative fines, one non-taxable minimum income of citizens is equal to 17 hryvnias.
The bill also establishes a separate limitation period for holding individuals administratively liable for financial violations - up to one year from the date they are committed.
The Ministry of Finance explained that the current limitation periods are often insufficient. Violations may be discovered only during state financial control measures, when the period for imposing a penalty is already coming to an end. As a result, those responsible avoid liability.
The amounts of fines provided for by Article 164 of the Code of Ukraine on Administrative Offenses have not been reviewed since 1996. In the ministry's view, they no longer ensure proper financial discipline or prevent repeated violations.
This is the resubmission of a bill that was previously registered under number 15043. The previous document was withdrawn after the powers of the previous Cabinet of Ministers expired.
The bill will soon be submitted for consideration by Parliament.
