Georgia judge rejects request to dismiss Donald Trump's cases

In the election meddling and federal classified documents cases, a Georgia judge rejected former President Trump's request to dismiss the prosecution.

The election fraud case against Donald Trump in the US state of Georgia has been unsuccessful, with the judge rejecting a request to dismiss the case on constitutional grounds. Trump's lawyers argued that the First Amendment to the U.S. Constitution was applicable in the case, as it, among other things, protects freedom of speech in the United States. However, Judge Scott McAfee rejected this argument on Thursday, as the US media constantly reported with reference to court documents.

Even major political statements are not protected from prosecution if they are allegedly used for criminal behavior

 ," McAfee said, explaining his decision. Only a jury can decide whether there was criminal intent behind the statements made by Trump and his co-defendants.

"President Trump and the other defendants respectfully disagree with Judge McAfee's decision and will continue to evaluate their options for a First Amendment challenge," said Steve Sadow, Trump's lead attorney in the Georgia case.

A spokesperson for the Fulton County District Attorney's Office, which is prosecuting the case, declined to comment.

Trump and several others have been indicted in Georgia for attempting to change the outcome of the 2020 presidential election in the state, after the Republican lost to Democrat Joe Biden.  Trump allegedly tried in various ways to change the outcome of the election retroactively, including by putting pressure on political leaders in the federal government and in states such as Georgia.
