The Appeals Chamber of the High Anti-Corruption Court has overturned the decision of the first instance court to close the first episode of the Rotterdam+ case. This is reported by UNN with reference to the court.
It is reported that on December 14, the HACC Appeals Chamber considered the prosecution's appeal against the HACC decision of October 9, 2023, to close criminal proceedings on the grounds of a criminal offense in the Rotterdam+ case.
The appeal was considered within the framework of the case of possible abuse by officials during the implementation and operation of the so-called "Rotterdam+" formula (part 5 of Article 27, part 2 of Article 28, part 2 of Article 364 of the Criminal Code of Ukraine).
"Based on the results of the review, the panel of judges upheld the prosecution's appeal, overturned the decision of the HACC investigating judge to close the criminal proceedings and cancel the seizure of property, and ordered a retrial in the court of first instance," the statement said.
Addendum
The High Anti-Corruption Court closed the first episode in the Rotterdam+ case due to the expiration of the pre-trial investigation after serving a person with a notice of suspicion.
